1. Agreement and scope
These Terms of Service govern access to and use of VDSROOT websites, accounts, virtual private servers, cloud compute, dedicated servers and related support services. By ordering, accessing or using a service, the customer agrees to these Terms, the Acceptable Use Policy, Privacy Policy and any product-specific description shown at checkout.
The customer must be legally capable of entering into a contract and must provide complete, current and accurate account, billing and verification information.
2. Orders, verification and activation
All orders are subject to availability, payment confirmation, fraud screening and identity or business verification where reasonably required. An order confirmation does not guarantee acceptance until the service is activated.
Deployment estimates are indicative. Custom configurations, dedicated hardware, manual review and supplier availability may extend delivery times.
3. Fees, billing and renewals
Prices, billing periods, included resources and taxes are displayed before purchase. Unless otherwise stated, services are billed in advance. The customer authorises charges using the selected payment method and is responsible for keeping payment details current.
Unpaid services may be restricted, suspended or terminated after reasonable notice where practicable. Restoring a suspended service may require payment of all outstanding amounts and may not be possible after data has been deleted.
4. Customer responsibilities
The customer is responsible for account credentials, operating-system administration, software licences, application security, user access, configurations, content, logs and backups unless a written managed-service description states otherwise.
The customer must promptly install security updates, use strong authentication, protect private keys and notify VDSROOT of suspected unauthorised access. Activity performed through the customer account is treated as authorised until VDSROOT is notified.
5. Backups and data
Unless a purchased plan expressly includes backups, VDSROOT does not promise to create or retain backups. Even when snapshots or backups are offered, the customer must maintain independent, tested copies of important data.
On cancellation, expiration or termination, data may be deleted and may be irrecoverable. The customer is responsible for exporting data before service termination.
6. Availability, maintenance and changes
VDSROOT may perform emergency or scheduled maintenance, replace hardware, move workloads within the selected region, change upstream providers or implement security measures needed to protect the service. Reasonable efforts will be made to reduce disruption.
Any uptime commitment or service credit applies only when expressly stated in the Service Level Agreement and is the customer’s sole remedy for qualifying availability failures.
7. Suspension and termination
VDSROOT may suspend or terminate services for non-payment, security risk, legal obligation, fraud, prohibited use, material breach, abusive conduct or activity that threatens customers, networks or third parties. In urgent cases, action may be taken without prior notice.
Customers may cancel through the available account process or by contacting admin@vdsroot.com. Fees already incurred remain payable. Refund eligibility is limited to any written refund policy presented at purchase and applicable mandatory consumer law.
8. Third-party services and licences
Operating systems, control panels, software images, network carriers, data centres and payment providers may be supplied by third parties and may have separate licence terms. The customer is responsible for complying with those terms.
9. Warranties and liability
Services are supplied on an “as available” basis to the maximum extent permitted by law. No service can be guaranteed to be uninterrupted, error-free or suitable for every purpose.
To the maximum extent permitted by law, VDSROOT is not liable for indirect, consequential or special loss, lost profit, lost revenue, business interruption or loss of data. Any aggregate liability is limited to the fees paid for the affected service during the three months preceding the event, except where such limitation is prohibited by law.
10. Changes, notices and contact
These Terms may be updated to reflect legal, security, operational or product changes. Material changes will be communicated through the website, account area or email where appropriate. Continued use after the effective date constitutes acceptance where permitted by law.
